Should Davis be on the recall ballot?

If Davis was put on the ballot and lost the recall portion, he could still win with the theoretical 20% of the vote that anyone else could or whatever.  Thus, a majority of Californians have indicated they they do not want him as Governor, but he is then re-elected by a minority?  That's even more unfair than the original case presented.  Just because he got more votes than the rest of the candidates wouldn't mean anything because we already know that whatever they think about the other candidates, we know the majority doesn't want him.  

What is unfair is that after the perfectly sound recall vote of the Governor, that someone could then win with a rather small minority of votes, whether Davis is on there or not.  That's what needs fixing.
